On September 26, AmCham held its annual Legal Seminar - an initiative of AmCham’s Legal Committee, this year hosted by Norton Rose Fulbright in Amsterdam. The focus this year was on trends in regulatory enforcement and crisis management. Compliance and enforcement risks have risen sharply in recent years for business corporations and financial institutions operating globally. More and more, these organizations find themselves subject to multijurisdictional enforcement, dealing with various regulatory authorities investigating similar or related misconduct. In addition to skyrocketing fines, individual employees and executives are subject to personal liability risk that is not always fully covered by D&O insurance policies. The stakes have never been higher in global enforcement, and compliance is frequently propelled to the top item list of board agendas.
