AMCHAM TEVREDEN MET BEROEP STARBUCKS
De Amerikaanse Kamer van Koophandel in Nederland (AmCham) juicht toe dat de Nederlandse regering beroep heeft aangetekend tegen het besluit van de Europese Commissie in de zaak-Starbucks. “Gelukkig, want nu zal duidelijk worden dat er met de Nederlandse praktijk helemaal niets mis is”, stelt Arjan van der Linde, voorzitter van het AmCham Tax Committee.
De Europese Commissie concludeerde vorige maand dat Starbucks een selectief fiscaal voordeel had verkregen. De Nederlandse regering liet eerder al weten verbaasd te zijn over deze beslissing en heeft nu besloten beroep aan te tekenen bij het Europese Hof van Justitie in Luxemburg.
"Nederland houdt zich keurig aan de internationale regels die in OECD-verband zijn afgesproken", aldus Van der Linde. Hij wijst er op dat het Nederlandse verrekenprijzenmodel al voldoet aan de strengere eisen uit het recente OECD BEPS project. Dat de Europese Commissie met het staatssteuninstrument de Nederlandse rulingpraktijk nu aan het wankelen probeert te brengen, is zeer schadelijk voor de Nederlandse economie”, aldus Van der Linde. “Amerikaanse multinationals zoals Starbucks zijn goed voor circa 450.000 banen in Nederland. Door inmenging van de Europese Commissie in de nationale rulingpraktijk wordt onzekerheid gecreëerd over bestaande rulings tussen in Nederland gevestigde multinationals en de Nederlandse overheid. Multinationals vragen zich af wat een afspraak met de overheid nog waard is, en gaan op zoek naar alternatieven. Die ontwikkeling is fnuikend voor het Nederlandse investeringsklimaat.”
“Het gaat hier dus niet om brievenbusmaatschappijen en trustkantoren, maar om échte bedrijven met échte werknemers. Gelukkig laat de Nederlandse regering nu zien dat zij ook daadwerkelijk staat voor haar handtekening, zodat een deel van de ontstane onrust zal kunnen worden weggenomen. Ik verwacht dat de Europese Commissie door het Hof in de Starbucks-zaak op de vingers zal worden getikt. De gedragsverandering die de Europese Commissie voorstaat, moet worden bewerkstelligd via Europese wetgeving. Daar is unanimiteit van stemmen voor nodig. Slinks gebruik van het staatssteuninstrument door de Europese Commissie is niet de geëigende weg,” aldus Van der Linde.
Van der Linde houdt er rekening mee dat de Europese Commissie in reactie op het Nederlands beroep nieuwe staatssteunzaken tegen Nederland zal openen. “Landen als Duitsland, Frankrijk, het VK en Italië hebben de druk op het Nederlandse vestigingsklimaat zeer hoog opgevoerd. Zij azen op onze buitenlandse investeerders en de daarbij behorende werkgelegenheid. De Nederlandse regering moet voorkomen dat Nederland via een schimmige achterdeur door de Europese Commissie wordt benadeeld ten gunste van deze landen.”

AMCHAM SATISFIED WITH APPEAL STARBUCKS
The American Chamber of Commerce in the Netherlands (AmCham) is pleased that the Dutch Government has appealed against the decision of the European Commission in the case of Starbucks. "Now it will become clear that there is nothing wrong with the Dutch practice," says Arjan van der Linde, Chairman of AmCham Tax Committee.
The European Commission concluded last month that Starbucks had obtained a selective tax advantage. The Dutch government had previously announced to be surprised about this decision and has now decided to appeal the decision at the European Court of Justice in Luxembourg.
"The Netherlands adheres to the international rules agreed at OECD level," says Van der Linde. He points out that the Dutch transfer pricing model already meets the stringent requirements of the recent OECD BEPS project. It is very harmful to the Dutch economy that the European Commission now tries to undermine the Dutch ruling practice through the state aid instrument," says Van der Linde. "US multinationals like Starbucks account for approximately 450 000 jobs in the Netherlands. The intervention of the European Commission in the national ruling practice creates uncertainty about existing rulings between multinationals based in the Netherlands and the Dutch government. Multinationals are questioning the value of an agreement with the Dutch government, and are starting to look for alternatives. This development is ruinous for the Dutch investment climate. "
"This is not about shelf companies and trust companies, but about real businesses with real employees. Fortunately, the Dutch government now underwrite their signature, so some of the current unrest will subside. I expect that the European Commission will be disavowed by the Court in the Starbucks case. The behavioral change advocated by the European Commission should be achieved through European legislation. This requires an unanimous vote. Underhand use of the state aid instrument by the European Commission is not the appropriate way," says Van der Linde.
Van der Linde takes into account that the European Commission will open new state aid cases against the Netherlands in response to the Dutch appeal. "Countries like Germany, France, UK and Italy are relentlessly increasing the pressure on the Dutch business climate. They compete for our foreign investors and the accompanying jobs. The Dutch government must prevent that the Netherlands is disadvantaged by the European Commission through a shadowy back door, in favor of these countries. "
