State Aid Proceedings Based on Taxation: How Does This Actually Work?

On May 30, 2018, AmCham members were welcomed at the offices of De Brauw Blackstone Westbroek in Amsterdam for a seminar on how state aid proceedings work, and how to deal with them.

The European Commission has recently opened several state aid investigations into the taxation practices of multinationals - and this is just the beginning. Much has been said and written on what practices and rulings may or may not constitute state aid, but the practicalities and procedural aspects should not be overlooked.

Over 30 legal professionals were present to listen to presentations from various speakers and to engage in a lively discussion. This discussion looked at many questions including: What happens if the European Commission starts asking questions about a tax ruling?, What are the company's rights and obligations?, What can be expected during this process, and how can a company influence the outcome?
